These Terms of Service ("Terms") govern your access to and use of SwishScript ("we," "us," "our") at swishscript.com (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the Service.
1. Eligibility
You must be at least 18 years old to use SwishScript. By using the Service, you represent and warrant that you meet this requirement and have the legal authority to enter into these Terms.
2. Account Registration
You must provide accurate, current, and complete information when creating your account. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
You agree to notify us immediately at support@swishscript.com of any unauthorized use of your account. We are not liable for any loss resulting from unauthorized use of your account.
3. Subscription & Billing
Free Trial: New accounts receive a 7-day free trial. No charge is made until the trial period ends. You may cancel at any time during the trial at no cost.
Subscription Fee: After the trial, SwishScript costs $4.99 per month, billed monthly. Your subscription automatically renews each month until cancelled.
Team Members: Assistant coaches invited to your team access the Service under your subscription at no additional cost. The head coach (account owner) is responsible for all subscription charges.
Payment Processing: All payments are processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis.
Cancellation: You may cancel your subscription at any time from your Account settings. Your access continues until the end of the current billing period. No refunds are issued for partial months.
Price Changes: We may change our pricing with at least 30 days advance notice. Continued use after the price change takes effect constitutes acceptance of the new price.
4. Acceptable Use
You agree to use SwishScript only for lawful purposes and in a manner consistent with these Terms. You agree NOT to:
- Use the Service for any illegal purpose or in violation of any applicable law
- Share your account credentials with unauthorized users
- Attempt to reverse engineer, decompile, or extract the source code of the Service
- Use automated tools to scrape, copy, or extract drill data from the Service
- Upload or transmit any malicious code, viruses, or harmful content
- Interfere with or disrupt the integrity or performance of the Service
- Create multiple accounts to circumvent subscription requirements
5. Intellectual Property
Our Content: The SwishScript platform, drill database (1,200+ drills, descriptions, and categorizations), design, logos, and all related content are owned by SwishScript and protected by copyright and intellectual property laws. You may not copy or redistribute this content outside the Service.
Your Content: Practice plans, custom drills, and notes you create belong to you. By using the Service, you grant us a limited license to store and display your content to you and your team members as part of providing the Service.
6. Team Features
As head coach (account owner), you are responsible for all team members you invite and their use of the Service. You may remove team members at any time from your Team settings.
Team members who leave or are removed lose access to the shared team content. Their personally-created content remains in their account.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
SwishScript is a planning and organization tool. We make no guarantee regarding the effectiveness of any drills or practice plans for athletic performance or outcomes.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWISHSCRIPT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
9. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms, with or without notice. You may terminate your account at any time by cancelling your subscription and contacting us to delete your account.
Upon termination, your right to use the Service ceases immediately. We may retain your data for up to 30 days after termination before deletion.
10. Governing Law
These Terms are governed by the laws of the United States. Any dispute arising from these Terms shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property violations.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the app. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
